Did you ever wonder how debt settlement companies operate, or who they help?
Enrollment agents - their responsibility is to proficiently explain the process of debt settlement and how it works, quote your new monthly payment and program duration, send your information to an underwriting department, await approval, then (if approved) present your debt settlement contract.
Underwriters - their job is to pull your credit score, evaluate your budgeting information / debt-to-income ratio gathered from the enrollment agent then decide whether or not your situation is suitable for debt settlement. Also, the underwriter's must make sure you're enrolling only the debts / accounts you choose, because often times a client will not have their financial statements handy - no problem we find out the account numbers and pertinent information all presented in your contract and agreement.
Basically, there's three ways you could be denied debt settlement (some companies underwriting procedures may differ).
1. If we can't see you saving at least 42% of your debt enrolled you won't be eligible.
2. If you can't afford the lowest possible payment at the longest duration, eligibility will be denied.
3. If you live in one of three states debt settlement is not compliant.
Debt Settlement Agents and / or Debt Negotiation Attorneys - the Debt Settlement Company will not know which category you fall under until your state of residence is known, why? Because, by law some states require an attorney to represent you. Their duty is to manage your account, start communication with your creditors, negotiate settlements for each account enrolled, if necessary send collection agencies cease and assist letters. FYI: the Debt Settlement Company settles one account at a time, from the account that renders the lowest balance to the highest balance.
Retention Department - need to make changes to your debt settlement program? Maybe you had a slow month at work, and your payments are to high, or the payment date needs to be moved.
